1 A JOINT RESOLUTION APPLYING TO CONGRESS FOR AN ARTICLE V CONVENTION
2 OF THE STATES WITH THE PURPOSE OF PROPOSING AMENDMENTS TO THE
3 UNITED STATES CONSTITUTION.
4 Whereas, the founders of the United States Constitution empowered state legislators
5 to be guardians against actual or potential abuses of power by the federal government; and
6 Whereas, the federal government has increasingly usurped legitimate roles of the
7 states; and
8 Whereas, the federal government has created a crushing national debt through
9 unsustainable budgeting and spending; and
10 Whereas, it is the solemn duty of the states to protect freedom and opportunity for our
11 citizens, including the generations to come; and
12 Whereas, Article V of the Constitution of the United States authorizes a process to
13 propose amendments to the United States Constitution through a convention of the states to place
14 clear restraints on these and related abuses of power; Now, therefore,
15 Be it resolved by the Senate, the House of Representatives concurring:
16 SECTION 1. The legislature of the State of North Carolina hereby applies to
17 Congress, under the provisions of Article V of the Constitution of the United States, for the
18 calling of a convention of the states limited to proposing amendments to the United States
19 Constitution that impose fiscal restraints on the federal government, limit the power and
20 jurisdiction of the federal government, and limit the terms of office for its officials and for
21 members of Congress.
22 SECTION 2. This application constitutes a continuing application in accordance
23 with Article V of the Constitution of the United States until the legislatures of at least two-thirds
24 of the several states have made applications on the same subject.
25 SECTION 3. The Secretary of State shall transmit copies of this application to the
26 President of the United States, Secretary of the United States Senate, the Speaker and Clerk of
27 the United States House of Representatives, the members of North Carolina's congressional
28 delegation, and the presiding officers of all state legislatures in the several states requesting their
29 cooperation.
30 SECTION 4. This resolution is effective upon ratification.
