3 CERTIFICATE OF TITLE FOR ALL-TERRAIN VEHICLES AND UTILITY VEHICLES,
4 INCREASING THE REGISTRATION FEE FOR MODIFIED UTILITY VEHICLES, AND
5 EXPANDING THE STREETS OR HIGHWAYS ON WHICH A MODIFIED UTILITY
6 VEHICLE MAY BE LEGALLY OPERATED.
7 The General Assembly of North Carolina enacts:
8 SECTION 1. Article 3 of Chapter 20 of the General Statutes is amended by adding
9 a new section to read:
10 "§ 20-53.6. Titling of all-terrain vehicles and utility vehicles.
11 Any owner of an all-terrain vehicle, modified utility vehicle, or utility vehicle may apply to
12 the Division for a certificate of title by completing an application on a form provided by the
13 Division and paying the fee established under G.S. 20-85(a)(1). The application form shall
14 require, at a minimum, the following:
15 (1) The owner's name.
16 (2) The owner's mailing address and residence address.
17 (3) The owner's drivers license number, which shall be provided as authorized by
18 G.S. 20-52(a)(1a)b.
19 (4) A description of the vehicle, including the make and model."
20 SECTION 2. G.S. 20-54 reads as rewritten:
21 "§ 20-54. Authority for refusing registration or certificate of title.
22 The Division shall refuse registration or issuance of a certificate of title or any transfer of
23 registration upon any of the following grounds:
24 …
25 (8) The vehicle is a golf cart or utility vehicle.cart. If the vehicle is an all-terrain
26 vehicle or utility vehicle, the Division shall refuse registration or any transfer
27 of registration but shall issue a certificate of title as provided by G.S. 20-53.6.

29 SECTION 3. G.S. 20-87 reads as rewritten:
30 "§ 20-87. Passenger vehicle registration fees.
31 These fees shall be paid to the Division annually for the registration and licensing of
32 passenger vehicles, according to the following classifications and schedules:
33 …
34 (12) Low-Speed Vehicles, Mini-Trucks, and Modified Utility Vehicles. – The fee
35 for a low-speed vehicle, mini-truck, or modified utility vehicle is the same as
36 the fee for private passenger vehicles of not more than 15 passengers.

1 However, the fee for any low-speed vehicle, mini-truck, or modified utility
2 vehicle that is offered for rent shall be the same as the fee for a U-drive-it
3 automobile. An additional fee of twenty-five dollars ($25.00) is imposed on a
4 modified utility vehicle in addition to any other required registration fees.

6 SECTION 4. G.S. 20-121.1 reads as rewritten:
7 "§ 20-121.1. Operation of a low-speed vehicle, mini-truck, or modified utility vehicle on
8 certain roadways.
9 The operation of a low-speed vehicle, mini-truck, or modified utility vehicle is authorized
10 with the following restrictions:
11 (1) A low-speed vehicle may be operated only on streets and highways where the
12 posted speed limit is 35 miles per hour or less. A mini-truck or modified utility
13 vehicle may be operated only on streets and highways where the posted speed
14 limit is 55 miles per hour or less; provided, a modified utility vehicle may not
15 be operated on any street or highway having four or more travel lanes unless
16 the posted speed limit is 35 miles per hour or less. This subdivision does not
17 prohibit a low-speed vehicle, mini-truck, or modified utility vehicle from
18 crossing a road or street at an intersection where the road or street being
19 crossed has a posted speed limit of more than 35 miles per hour.

21 SECTION 5. This act becomes effective October 1, 2022, and applies to registrations
22 or certificates of title issued on or after that date.
