3 MAGNETIC RESONANCE IMAGING SCANNERS BY SPECIALTY AND
4 MULTISPECIALTY PROFESSIONAL CORPORATIONS OF PHYSICIANS LICENSED
5 TO PRACTICE MEDICINE IN NORTH CAROLINA.
6 The General Assembly of North Carolina enacts:
7 SECTION 1. G.S. 131E-184 is amended by adding a new subsection to read:
8 "(i) The Department shall exempt from certificate of need review the acquisition of a
9 magnetic resonance imaging scanner by purchase, donation, lease, transfer, or comparable
10 arrangement by any specialty or multispecialty professional corporation of physicians licensed
11 to practice medicine under Chapter 90 of the General Statutes if the following conditions are met:
12 (1) The magnetic resonance imaging scanner will be used only for the patients of
13 that same physician practice or group.
14 (2) The single specialty or multispecialty physician practice or group proposing
15 to acquire a magnetic resonance imaging scanner shall provide prior written
16 notice to the Department, along with supporting documentation to
17 demonstrate that it meets the exemption criteria of this subsection."
18 SECTION 2. This act becomes effective October 1, 2021.
