2 AN ACT ESTABLISHING A UNIFORM RATE-SETTING PROCESS FOR ADULT DAY
3 CARE SERVICES AND ADULT DAY HEALTH SERVICES FUNDED BY THE HOME
4 AND COMMUNITY CARE BLOCK GRANT AND THE STATE ADULT DAY CARE
5 FUND.
6 The General Assembly of North Carolina enacts:
7 SECTION 1. Notwithstanding any provision of G.S. 143B-153,
8 G.S. 143B-181.1(a)(11), or any other provision of law to the contrary, the maximum rates
9 established by the Department of Health and Human Services for adult day care services and
10 adult day health services funded by the Home and Community Care Block Grant or the State
11 Adult Day Care Fund are repealed.
12 SECTION 2. Part 14 of Article 3 of Chapter 143B of the General Statutes is amended
13 by adding a new section to read:
14 "§ 143B-181.1C. Boards of county commissioners to set maximum rates for services funded
15 by the Home and Community Care Block Grant and the State Adult Day Care
16 Fund.
17 The board of county commissioners or a designee of the board shall determine the maximum
18 rates for all services funded by the county's allocations from the Home and Community Care
19 Block Grant and the State Adult Day Care Fund, including adult day care services and adult day
20 health services."
21 SECTION 3. This act is effective when it becomes law.
