2 AN ACT TO CHANGE THE ELECTION METHOD FOR THE ALEXANDER COUNTY
3 BOARD OF EDUCATION FROM NONPARTISAN TO PARTISAN.
4 The General Assembly of North Carolina enacts:
5 SECTION 1. Section 3 of Chapter 774 of the 1969 Session Laws reads as rewritten:
6 "Sec. 3. Members Beginning in 2022, members of the Alexander County Board of Education
7 shall be elected in a non-Partisan Election partisan election to be held at the time of the general
8 election for nomination of candidates for the General Assembly. Candidates for the office of
9 membership on the Board of Education of Alexander County shall be eligible electors and shall
10 file notice of candidacy with the County Board of Elections of Alexander County in the same
11 manner and at such time as that for candidates for the General Assembly prior to the date of said
12 primary election, and notice of candidacy shall be accompanied by a filing fee of ten ($10.00)
13 dollars. in each even-numbered year as terms expire. The primary and election shall be held and
14 conducted in accordance with the general laws governing primaries and elections for county
15 officers, except as otherwise provided herein. The notice of candidacy shall state the name, age,
16 residence and district of the candidate, together with a statement that such candidate desires to
17 be voted upon as a member of said Alexander County Board of Education."
18 SECTION 2. Section 7 of Chapter 774 of the 1969 Session Laws reads as rewritten:
19 "Sec. 7. In the event the number of candidates in a district does not exceed the number of
20 vacancies to be filled in that district, no election shall be necessary and the candidate(s) shall be
21 declared elected. Vacancies For positions elected on a nonpartisan basis in 2018 or 2020,
22 vacancies on the Board which arise during a term of office shall be filled for the unexpired term
23 by majority vote of the remaining members of the Board of Education of Alexander County.
24 Beginning in 2022, positions elected on a partisan basis shall be filled by appointment by the
25 remaining members of the Board in accordance with G.S. 115C-37.1."
26 SECTION 3. This act does not affect the terms of office of any person elected in
27 2018 or 2020 to the Alexander County Board of Education. Each member of the Alexander
28 County Board of Education elected in 2018 and 2020, or any member appointed to fill a vacancy
29 for a member elected in 2018 or 2020, shall serve until a successor has been elected and qualified.
30 SECTION 4. Effective the first Monday in December of 2022, G.S. 115C-37.1(d)
31 reads as rewritten:
32 "(d) This section shall apply only in the following counties: Alexander, Alleghany,
33 Beaufort, Brunswick, Carteret, Cherokee, Clay, Cleveland, Dare, Davie, Graham, Guilford,
34 Harnett, Hyde, Iredell, Lee, Madison, New Hanover, Onslow, Pender, Rutherford, Stanly,
35 Stokes, Surry, Vance, Washington, and Yancey."
