Short Title: Carbon Monoxide Detectors/School Bldgs. (Public)

2 AN ACT TO REQUIRE THE INSTALLATION OF CARBON MONOXIDE DETECTORS IN
3 ALL PUBLIC AND PRIVATE SCHOOLS IN THE STATE OF NORTH CAROLINA.
4 The General Assembly of North Carolina enacts:
5 SECTION 1. G.S. 115C-12 is amended by adding a new subdivision to read:
6 "(47) The State Board of Education shall adopt rules applicable to all public school
7 units that require existing school buildings to be equipped with adequate
8 carbon monoxide alarms and new school buildings placed into service on or
9 after July 1, 2025, to be equipped with adequate carbon monoxide detectors.
10 For purposes of this subdivision, "adequate carbon monoxide alarms" are
11 those meeting the American National Standards Institute/Underwriters
12 Laboratory standard ANSI/UL 2034 and installed in accordance with the
13 National Fire Protection Association standard NFPA 720, and "adequate
14 carbon monoxide detectors" are those meeting the American National
15 Standards Institute/Underwriters Laboratory standard ANSI/UL 2075 and
16 installed in accordance with the National Fire Protection Association standard
17 NFPA 720."
18 SECTION 2. The State Board of Education may adopt temporary rules to implement
19 the requirements of this act. The temporary and permanent rules required by G.S. 115C-12(47),
20 as enacted by Section 1 of this act, shall ensure that the requirement for existing school buildings
21 to have adequate carbon monoxide alarms takes effect no later than July 1, 2023.
22 SECTION 3. This act is effective when it becomes law.
