 2   AN ACT TO ALLOW NET PROCEEDS FROM THE SALE OF CERTAIN LANDS OWNED
 3       BY OR UNDER THE CONTROL OF THE DEPARTMENT OF NATURAL AND
 4       CULTURAL RESOURCES TO BE DEPOSITED INTO SPECIAL FUNDS TO BE USED
 5       FOR THE BENEFIT OF CERTAIN STATE HISTORIC SITES AND MUSEUMS.
 6   The General Assembly of North Carolina enacts:
 7               SECTION 1. G.S. 146-30 reads as rewritten:
 8   "§ 146-30. Application of net proceeds.
 9       (a)     The net proceeds of any disposition made in accordance with this Subchapter shall be
10   handled in accordance with the following priority:
11               (1)     First, in accordance with the provisions of any trust or other instrument of title
12                       whereby title to real property was acquired.
13               (2)     Second, as provided by any other act of the General Assembly.
14               (3)     Third, by depositing the net proceeds with the State Treasurer.
15   Nothing in this section, however, prohibits the disposition of any State lands by exchange for
16   other lands, but if the appraised value in fee simple of any property involved in the exchange is
17   at least twenty-five thousand dollars ($25,000), then the exchange shall not be made without
18   consultation with the Joint Legislative Commission on Governmental Operations.

20       (d)     Notwithstanding any other provision of this Subchapter, the following exceptions
21   apply:

23               (11) The net proceeds derived from the sale of land owned by or under the control
24                       of the Division of State Historic Sites and the Division of State History
25                       Museums in the Department of Natural and Cultural Resources shall be
26                       deposited in the State Historic Sites and Museums Fund, created in
27                       G.S. 121-7.7(a), and shall be used in accordance with that section. This
28                       subdivision shall not apply to the Bentonville Battlefield State Historic Site or
29                       the North Carolina Transportation Museum.
30               (12) The net proceeds derived from the sale of land owned by or under the control
31                       of the Division of Tryon Palace Historic Sites and Gardens in the Department
32                       of Natural and Cultural Resources shall be deposited in the Tryon Palace
33                       Historic Sites and Gardens Fund, created in G.S. 121-21.1(a), and shall be
34                       used in accordance with that section."
35               SECTION 2. This act is effective when it becomes law.
