Short Title: Plan A for Charter Schools. (Public)

2 AN ACT TO ALLOW CHARTER SCHOOLS TO PROVIDE PLAN A INSTRUCTION TO
3 THE SAME EXTENT AS LOCAL SCHOOL ADMINISTRATIVE UNITS.
4 The General Assembly of North Carolina enacts:
5 SECTION 1. Notwithstanding any provision of law to the contrary, for the remainder
6 of the 2020-2021 school year, a charter school may provide in-person instruction under Plan A
7 (Minimal Social Distancing) in accordance with the StrongSchoolsNC Public Health Toolkit
8 (K-12) (Toolkit), as that guidance existed on March 4, 2021, to any grade level. A charter school
9 that, in its discretion, provides in-person instruction under Plan A to students in grades six
10 through 12 shall do all of the following:
11 (1) Notify the Department of Health and Human Services and describe the charter
12 school's plan for moving to Plan A for grades six through 12 before beginning
13 Plan A instruction.
14 (2) Partner with the ABC Science Collaborative of the School of Medicine at
15 Duke University (ABC Collaborative) to allow the ABC Collaborative to
16 collect and analyze data from those units for students in Plan A in grades six
17 through 12.
18 (3) Engage in robust contact tracing and report on requested information in the
19 form specified by the ABC Collaborative.
20 SECTION 2. This act is effective when it becomes law.
