Short Title: Improve Anatomical Gift Donation Process. (Public)

4 ORIGINALLY BECAME DONORS IN ANOTHER JURISDICTION TO CONSENT TO
5 THE IMPRINTING OF AN ANATOMICAL GIFT STATEMENT OR SYMBOL ON THE
6 DONOR'S NORTH CAROLINA DRIVERS LICENSE OR IDENTIFICATION CARD
7 AND BY CLARIFYING WHEN AN ANATOMICAL GIFT MADE BY AUTHORIZING
8 THAT A STATEMENT OR SYMBOL BE IMPRINTED ON THE DONOR'S DRIVERS
9 LICENSE OR IDENTIFICATION CARD WILL BE CONSIDERED REVOKED.
10 The General Assembly of North Carolina enacts:
11 SECTION 1. G.S. 130A-412.7(a) reads as rewritten:
12 "(a) A donor may make an anatomical gift by any of the following methods:
13 (1) By authorizing that a statement or symbol be imprinted on the donor's drivers
14 license or identification card indicating that the donor has made an anatomical
15 gift. A donor who originally became a donor in another jurisdiction is required
16 to authorize that a statement or symbol be imprinted on the donor's drivers
17 license or identification card issued in this State in order for the anatomical
18 gift to be valid under this subdivision. Anatomical gifts made by this method
19 shall not include a donation of the donor's body.
20 …."
21 SECTION 2. G.S. 130A-412.7 is amended by adding a new subsection to read:
22 "(c1) A statement or symbol on a drivers license or identification card issued in this State
23 indicating that the donor has made an anatomical gift shall remain on the donor's drivers license
24 or identification card until the donor revokes consent to make an anatomical gift by requesting
25 removal of the statement or symbol from the drivers license or identification card in the manner
26 prescribed by the Division of Motor Vehicles."
27 SECTION 3. This act becomes effective October 1, 2021.
