Short Title: Medicaid Reimbursement/Charter Schools. (Public)

3 NECESSARY TO ALLOW CHARTER SCHOOLS TO RECEIVE MEDICAID
4 REIMBURSEMENT IN THE SAME MANNER AS LOCAL EDUCATION AGENCIES.
5 The General Assembly of North Carolina enacts:
6 SECTION 1. G.S. 115C-218.105 is amended by adding a new subsection to read:
7 "(g) Notwithstanding G.S. 115C-218.15(b), a charter school that is approved by the State
8 as a public school pursuant to this Article shall be deemed a local government entity that is
9 responsible, or assumes responsibility, either directly or indirectly through an agency or other
10 political subdivision, for the payment of the nonfederal share for reimbursable medical services,
11 including administrative activities related to those services, that are medically necessary and for
12 which federal payment is available under the NC Medicaid Program established under Part 6 of
13 Article 2 of Chapter 108A of the General Statutes. The nonfederal share shall consist exclusively
14 of public funds. For the purposes of this subsection, ''nonfederal share'' means the share of
15 expenditures for the reimbursable medical services that draws down federal financial
16 participation."
17 SECTION 2. G.S. 108D-35(4) reads as rewritten:
18 "(4) Services documented in an individualized education program, as defined in
19 G.S. 115C-106.3, or other document described in the Medicaid State Plan, and
20 provided or billed by a local education agency, as defined in
21 G.S. 115C-106.3.G.S. 115C-106.3 or a charter school that is qualified to
22 certify public expenditures."
23 SECTION 3. This act becomes effective July 1, 2021.
