5 The General Assembly of North Carolina enacts:
6 SECTION 1. G.S. 20-11 reads as rewritten:
7 "§ 20-11. Issuance of limited learner's permit and provisional drivers license to person who
8 is less than 18 years old.

10 (c) Level 1 Restrictions. – A limited learner's permit authorizes the permit holder to drive
11 a specified type or class of motor vehicle only under the following conditions:
12 (1) The permit holder must be in possession of the permit.
13 (2) A supervising driver must be seated beside the permit holder in the front seat
14 of the vehicle when it is in motion. No person other than the supervising driver
15 can be in the front seat.
16 (3) For the first six three months after issuance, the permit holder may drive only
17 between the hours of 5:00 a.m. and 9:00 p.m.
18 (4) After the first six three months after issuance, the permit holder may drive at
19 any time.
20 (5) Every person occupying the vehicle being driven by the permit holder must
21 have a safety belt properly fastened about his or her body, or be restrained by
22 a child passenger restraint system as provided in G.S. 20-137.1(a), when the
23 vehicle is in motion.
24 (6) The permit holder shall not use a mobile telephone or other additional
25 technology associated with a mobile telephone while operating the motor
26 vehicle on a public street or highway or public vehicular area.
27 (d) Level 2. – A person who is at least 16 years old but less than 18 years old may obtain
28 a limited provisional license if the person meets all of the following requirements:
29 (1) Has held a limited learner's permit issued by the Division for at least 12 six
30 months.
31 (2) Has not been convicted of a motor vehicle moving violation or seat belt
32 infraction or a violation of G.S. 20-137.3 during the preceding six months.
33 (3) Passes a road test administered by the Division.
34 (4) Has a driving eligibility certificate or a high school diploma or its equivalent.
35 (5) Has completed a driving log, on a form approved by the Division, detailing a
36 minimum of 60 hours as the operator of a motor vehicle of a class for which

1 the driver has been issued a limited learner's permit. The log must show at
2 least 10 hours of the required driving occurred during nighttime hours. No
3 more than 10 hours of driving per week may be counted toward the 60-hour
4 requirement. The driving log must be signed by the supervising driver and
5 submitted to the Division at the time the applicant seeks to obtain a limited
6 provisional license. If the Division has cause to believe that a driving log has
7 been falsified, the limited learner's permit holder shall be required to complete
8 a new driving log with the same requirements and shall not be eligible to
9 obtain a limited provisional license for six months.

11 SECTION 2.1.(a) The Division of Motor Vehicles shall utilize third-party vendors
12 to administer the road tests required by Article 2 of Chapter 20 pursuant to all of the following:
13 (1) Each vendor shall obtain a certification from the Division that the road test
14 administered by the vendor complies with criteria and training developed by
15 the Division.
16 (2) A vendor may charge a fee for a road test, as agreed upon by the Division and
17 the vendor. This fee shall be the only fee charged to the person for the road
18 test. Any fee charged to a person for a road test by a private vendor shall be
19 deducted from the fee charged by the Division under Article 2 of Chapter 20
20 of the General Statutes for issuance of the license for which the applicant is
21 required to take the road test.
22 (3) The Division shall maintain oversight of the road tests conducted by vendors.
23 SECTION 2.1.(b) No later than November 1, 2021, the Division shall report to the
24 Joint Legislative Transportation Oversight Committee on the overall implementation of this
25 section the number of vendors utilized by the Division; the training and criteria used by the
26 Division for the certification of a vendor; the fees charged by vendors for a road test, if road test
27 wait times were reduced; and the effect on customer service within the Division.
28 SECTION 3. This act is effective when it becomes law.
