2 AN ACT TO PROVIDE FUNDS FOR THE PLANNING AND CONSTRUCTION OF A NEW
3 BRODY SCHOOL OF MEDICINE AT EAST CAROLINA UNIVERSITY.
4 The General Assembly of North Carolina enacts:
5 SECTION 1.(a) There is transferred from the General Fund to the State Capital and
6 Infrastructure Fund the sum of fifteen million dollars ($15,000,000) for the 2020-2021 fiscal
7 year.
8 SECTION 1.(b) There is appropriated from the State Capital and Infrastructure Fund
9 to the Board of Governors of The University of North Carolina the sum of fifteen million dollars
10 ($15,000,000) for the 2020-2021 fiscal year to provide funds for the planning of a new Brody
11 School of Medicine at East Carolina University.
12 SECTION 2.(a) It is the intent of the General Assembly to transfer from the General
13 Fund to the State Capital and Infrastructure Fund the sum of thirteen million dollars
14 ($13,000,000) for the 2021-2022 fiscal year.
15 SECTION 2.(b) It is the intent of the General Assembly to appropriate from the
16 State Capital and Infrastructure Fund to the Board of Governors of The University of North
17 Carolina the sum of thirteen million dollars ($13,000,000) for the 2021-2022 fiscal year to
18 provide funds for the construction of a new Brody School of Medicine at East Carolina
19 University. The total amount authorized for the project is two hundred fifteen million dollars
20 ($215,000,000).
21 SECTION 3. The allocation of funds as provided by this act for the project for the
22 2020-2021 fiscal year and subsequent fiscal years shall be conditioned upon the existence of and
23 compliance with an affiliation agreement between The University of North Carolina or East
24 Carolina University and the primary affiliated teaching hospital for the East Carolina University
25 Brody School of Medicine. The affiliation agreement shall require that at least forty-five percent
26 (45%) of the members of the Board of Trustees of the primary affiliated teaching hospital be
27 appointed by the Board of Governors of The University of North Carolina.
28 SECTION 4. If House Bill 966, 2019 Regular Session, becomes law, and any
29 provision of that act or a provision of the Committee Report described in Section 42.2 of that act
30 conflicts with this act, this act shall control.
31 SECTION 5. This act becomes effective July 1, 2020.
