4 WHOSE BUSINESS WAS IMPACTED BY THE COVID-19 OUTBREAK IN NORTH
5 CAROLINA.
6 The General Assembly of North Carolina enacts:
7 SECTION 1. Appropriation & Reimbursement. – Notwithstanding any provision of
8 G.S. 18B-902 or G.S. 18B-903 to the contrary, there is appropriated from the General Fund to
9 the Department of Public Safety the sum of one million six hundred thousand dollars
10 ($1,600,000) in nonrecurring funds for the 2019-2020 fiscal year to be used to provide a one-time
11 reimbursement of mixed beverages permit fees paid under G.S. 18B-902(d) or G.S. 18B-903(b)
12 to permittees with an active mixed beverages permit as of March 1, 2020. To the extent
13 practicable, the amount reimbursed under this section shall only be a pro-rata share for the months
14 of March, April, and May of the year 2020, of the amount paid for mixed beverages permit
15 application or renewal fees. The Department of Public Safety may work with the ABC
16 Commission and any other State agency or department it deems necessary to work with to
17 implement the provisions of this act.
18 SECTION 2. Reversion. – The funds appropriated in Section 1 of this act shall not
19 revert at the end of the 2019-2020 fiscal year, but shall remain available to expend in accordance
20 with this act until June 30, 2021.
21 SECTION 3. Report. – By October 1, 2020, the ABC Commission shall submit a
22 report to the Joint Legislative Commission on Governmental Operations and the Fiscal Research
23 Division on (i) the amount of funds reimbursed, (ii) the number of permittees reimbursed, (iii)
24 the amount each permittee received as a reimbursement, and (iv) if the funds appropriated in
25 Section 1 of this act were insufficient to provide a pro-rata share, the amount of funds needed to
26 do so.
27 SECTION 4. Effective Date. – This act is effective when it becomes law.
