4 A BILL FOR AN ACT ENTITLED: “AN ACT ALLOWING THE DEPOSITION OF WITNESS IN PUBLIC
5 SERVICE COMMISSION PROCEEDINGS; PROVIDING RULEMAKING AUTHORITY; AMENDING SECTION
6 69-3-328, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 Section 1. Section 69-3-328, MCA, is amended to read:
11 "69-3-328. Depositions of witnesses. The commission or any party to any proceeding before it may
12 cause the depositions of witnesses to be taken in the manner prescribed by law for like depositions in civil
13 actions and by commission rule."

15 NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
