4 A BILL FOR AN ACT ENTITLED: “AN ACT REQUIRING AN ANNUAL REPORT ON HELP AMERICA VOTE
5 ACT FUNDS; ESTABLISHING REPORTING REQUIREMENTS; AMENDING SECTION 13-1-209, MCA; AND
6 PROVIDING AN IMMEDIATE EFFECTIVE DATE.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 Section 1. Section 13-1-209, MCA, is amended to read:
11 "13-1-209. Special account for federal Help America Vote Act. (1) There is a federal special
12 revenue account in the state treasury to the credit of the office of the secretary of state.
13 (2) Money provided to the state for the purposes of implementing provisions of Public Law 107-
14 252, the Help America Vote Act of 2002, must be deposited in the account.
15 (3) Money in the account may be used only for the purposes specified by the federal law under
16 which the money was provided.
17 (4) In accordance with 5-11-210 and by September 1 every year, the office of the secretary of state
18 shall present a report to the state administration and veterans' affairs interim committee on how much money is
19 received in the special account and how the funds are used."

21 NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
