4 A BILL FOR AN ACT ENTITLED: β€œAN ACT REQUIRING CUSTOMERS TO OPT-IN FOR ADVANCED
5 METERING DEVICE INSTALLATION; PROVIDING RULEMAKING AUTHORITY; REPEALING SECTION 69-
6 4-1004, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 NEW SECTION. Section 1. Advanced meter opt-in provisions -- rulemaking. (1) A utility shall
11 require customers to opt-in to the installation of all advanced metering devices located at an end user's
12 residence or business.
13 (2) A utility may not charge customers who do not opt-in to advanced metering device installation
14 additional fees or charges related to the customer decision to forego installation.
15 (3) If the commission determines an opt-in program should be established, the commission shall
16 adopt rules providing options and requirements for individual customers to opt-in to advanced metering device
17 installation.

19 NEW SECTION. Section 2. Repealer. The following section of the Montana Code Annotated is
20 repealed:
21 69-4-1004. Opt-out -- public service commission responsibilities -- rulemaking.

23 NEW SECTION. Section 3. Codification instruction. [Section 1] is intended to be codified as an
24 integral part of Title 69, chapter 4, part 10, and the provisions of Title 69, chapter 4, part 10, apply to [section 1].

26 NEW SECTION. Section 4. Effective date. [This act] is effective on passage and approval.
