4 A BILL FOR AN ACT ENTITLED: β€œAN ACT PROHIBITING A STATE GOVERNMENT ENTITY FROM
5 RENTING OR LEASING SPACE TO AN ORGANIZATION THAT FILES CAMPAIGN FINANCE REPORTS AS
6 A POLITICAL COMMITTEE; AND PROVIDING A DELAYED EFFECTIVE DATE AND AN APPLICABILITY
7 DATE.”

9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

11 NEW SECTION. Section 1. Limitation on renting or leasing state property. (1) An agency or the
12 university system may not rent or lease office space or real property to an organization that has been required
13 to register as a political committee within 1 year prior to the start of a rental or lease agreement.
14 (2) A rental or lease agreement for office space or real property that belongs to a state agency or the
15 university system and the renter or lessee must include a provision stating that should the renter or lessee be
16 required to disclose contributions or expenditures as a political committee pursuant to Title 13, chapter 37, the
17 rental or lease agreement will be terminated.
18 (3) For the purposes of this section, the following definitions apply:
19 (a) "Agency" means a department, board, commission, office, bureau, institution, or unit of state
20 government recognized in the state budget, including the university system.
21 (b) "Political committee" has the meaning provided in 13-1-101.

23 NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an
24 integral part of Title 2, chapter 17, part 1, and the provisions of Title 2, chapter 17, part 1, apply to [section 1].

26 NEW SECTION. Section 3. Effective date. [This act] is effective January 1, 2022.

28 NEW SECTION. Section 4. Applicability. [This act] applies to rental or lease agreements for office

1 space or real property that belongs to a state agency or the university system that is signed or renewed on or
2 after [the effective date of this act].
