4 A BILL FOR AN ACT ENTITLED: β€œAN ACT PROHIBITING EASEMENTS IN A PLATTED SUBDIVISION THAT
5 CROSS EXISTING LOTS OR PARCELS IF ROAD ACCESS CURRENTLY EXISTS.”

7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

9 NEW SECTION. Section 1. Prohibited easement. If an existing road or road easement provides
10 access to a lot in a platted residential subdivision, the owner of a lot or parcel in a platted residential subdivision
11 may not obtain a prescriptive easement for ingress or egress to the lot if the prescriptive easement crosses
12 other lots or parcels in the platted residential subdivision.

14 NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an
15 integral part of Title 70, chapter 17, part 1, and the provisions of Title 70, chapter 17, part 1, apply to [section 1].
