4 A BILL FOR AN ACT ENTITLED: β€œAN ACT PROVIDING CONFIDENTIALITY OF PERSONAL INFORMATION
5 FOR STATE LOTTERY GAMES AND SPORTS GAMBLING; AND PROVIDING EXCEPTIONS FOR COURT
6 ORDERS.”

8 WHEREAS, the Legislature recognizes the individual privacy rights of a lottery participant and winner
9 under Article II, section 10, of the Montana Constitution outweigh the public's right to know under Article II,
10 section 9; and
11 WHEREAS, this act legislatively recognizes this privacy interest.

13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

15 NEW SECTION. Section 1. Confidentiality of players. The personal information about a player who
16 participates in lottery games and sports gambling as provided in this chapter is confidential and may not be
17 disclosed to the public unless the player authorizes, in writing, the release of the information. Nothing in this
18 section prohibits:
19 (1) the state lottery from complying with 23-7-312; and
20 (2) disclosure of the information through an order issued by a court of competent jurisdiction on a
21 finding that the disclosure of the personal information is necessary because the merits of public disclosure
22 clearly exceed the demand for individual privacy.

24 NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an
25 integral part of Title 23, chapter 7, part 3, and the provisions of Title 23, chapter 7, part 3, apply to [section 1].
