4 A BILL FOR AN ACT ENTITLED: β€œAN ACT CLARIFYING THE START OF APPRENTICESHIP WAGES;
5 AMENDING SECTION 18-2-416, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.”

7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

9 Section 1. Section 18-2-416, MCA, is amended to read:
10 "18-2-416. Wages paid to registered apprentices. (1) (a) Only an apprentice whose indenture
11 agreement is registered with the department under Title 39, chapter 6, or recognized by the department as
12 being registered with an appropriate registration agency of another state or the federal government may be paid
13 as provided in subsection (2) when working on a public works contract.
14 (b) An apprentice whose indenture agreement is not registered with or recognized by the department
15 must be paid the full amount of the standard prevailing rate of wages, including any applicable travel
16 allowances.
17 (c) Apprenticeship wages start at the date of registration with the sponsor.
18 (2) A recognized, registered apprentice must be paid the percentage of the standard prevailing rate of
19 wages provided for in the apprenticeship standards applicable to that apprentice. The percentage amount
20 applies to wage rates only and not to fringe benefits. The full amount of any applicable fringe benefits must be
21 paid to the apprentice while the apprentice is working on the public works contract."

23 NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
