4 A BILL FOR AN ACT ENTITLED: β€œAN ACT PROVIDING THAT AN INTERLOCAL AGREEMENT MAY NOT
5 EXCEED A 5-YEAR DURATION; AND AMENDING SECTION 7-11-105, MCA.”

7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

9 Section 1. Section 7-11-105, MCA, is amended to read:
10 "7-11-105. Detailed contents of interlocal agreements. (1) The contract authorized by 7-11-104
11 must specify the following:
12 (1)(a) its duration that may not exceed 5 years after the date the agreement is filed as provided in 7-
13 11-107;
14 (2)(b) the precise organization, composition, and nature of any separate legal entity created by the
15 contract;
16 (3)(c) the purpose or purposes of the interlocal contract;
17 (4)(d) the manner of financing the joint or cooperative undertaking and establishing and maintaining a
18 budget for the undertaking;
19 (5)(e) the permissible method or methods to be employed in accomplishing the partial or complete
20 termination of the agreement and, if applicable, for disposing of property upon a partial or complete termination;
21 (6)(f) provision for an administrator or a joint board responsible for administering the joint or
22 cooperative undertaking, including representation of the contracting parties on the joint board;
23 (7)(g) if applicable, the manner of acquiring, holding, and disposing of real and personal property
24 used in the joint or cooperative undertaking;
25 (8)(h) the contracting party responsible for reports and payment of retirement system contributions
26 pursuant to 19-2-506;
27 (9)(i) if applicable, the manner of sharing the employment of a teacher or specialist under 20-4-201, a
28 superintendent under 20-4-401, or a professional person licensed under Title 37; and

1 (10)(j) any other necessary and proper matters.
2 (2) The limitation on duration in subsection (1)(a) does not apply to bond financing agreements,
3 including but not limited to those agreements provided for in 90-6-310."
