4 A BILL FOR AN ACT ENTITLED: “AN ACT CLARIFYING THAT ONLY LOCAL HEALTH OFFICERS MAY
5 REQUEST ASSISTANCE OF LAW ENFORCEMENT AND REMOVING THE POTENTIAL PENALTY IF LAW
6 ENFORCEMENT FAILS TO ASSIST; AND AMENDING SECTION 50-2-120, MCA.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 Section 1. Section 50-2-120, MCA, is amended to read:
11 "50-2-120. Assistance from law enforcement officials. A state or local health officer may request a
12 sheriff, constable, or other peace officer to assist the health officer in carrying out the provisions of this chapter.
13 If the officer does not render the service, the officer is guilty of a misdemeanor and may be removed from
14 office."
