4 A BILL FOR AN ACT ENTITLED: “AN ACT GENERALLY REVISING THE QUALIFICATIONS REQUIRED OF
5 A PERSON TO BE ELIGIBLE FOR ELECTION AS THE SUPERINTENDENT OF PUBLIC INSTRUCTION;
6 REMOVING THE REQUIREMENT THAT THE SUPERINTENDENT OF PUBLIC INSTRUCTION HOLD AT
7 LEAST A BACHELOR'S DEGREE TO BE QUALIFIED FOR ELECTION; AND AMENDING SECTION 20-3-101,
8 MCA.”

10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

12 Section 1. Section 20-3-101, MCA, is amended to read:
13 "20-3-101. Election and qualifications. (1) A superintendent of public instruction for the state of
14 Montana must be elected by the qualified electors of the state at the general election preceding the expiration
15 of the term of office of the incumbent.
16 (2) A person is qualified to assume the office of superintendent of public instruction who:
17 (a) is 25 years of age or older at the time of election;
18 (b) has resided within the state for the 2 years preceding the election; and
19 (c) holds at least a bachelor's degree from any unit of the Montana university system or from an
20 institution recognized as equivalent by the board of public education for teacher certification purposes; and
21 (d)(c) otherwise possesses the qualifications for office that are required by The Constitution of the
22 State of Montana."
