HB 1907 -- RETURNABLE CONTAINERS

This bill specifies that before a recycler can purchase five or more returnable containers from a person, the recycler must obtain certain information from the seller, verify the identity of the seller and that the individual is acting on behalf of a corporation, business, or government, and record the method of payment used to purchase the containers. The recycler must retain this information for one year.

If a person fails to comply with the provisions of this bill, he or she is liable for penalties ranging from $5,000 to up to $30,000 per incident depending on the violation. The Attorney General or the appropriate prosecuting attorney may inspect required records, investigate an alleged violation, and sue to collect a civil penalty for a violation. In addition to the civil penalties, a recycler who violates the provisions of the bill is guilty of a class C misdemeanor under certain circumstances.

This bill is similar to HB 749 (2021).
