HB 1461 -- PUBLIC FUND EXPENDITURES

This bill establishes the "Prioritization of Public Funding for Family Planning Act", which prioritizes the uses of public funding for family planning to first public entities, then nonpublic hospitals and federally qualified health centers, then rural health clinics, then nonpublic health care providers that have as their primary purpose the provision of the primary health care services enumerated in 42 U.S.C. 254b(b)(1). This bill also provides for civil remedies for non compliance with this prioritization including injunctive relief and rewarding attorney's fees.

This bill also prohibits public funds from being expended to any facility in which abortions are performed or induced or to any affiliate or associate of any such facility.

This bill has a severability clause.

This bill is similar to HB 861 (2019).
