HB 816 -- INTOXICATING LIQUOR

COMMITTEE ACTION: Voted "Do Pass" by the Standing Committee on General Laws by a vote of 12 to 0. Voted "Do Pass" by the Standing Committee on Rules- Legislative Oversight by a vote of 10 to 0.

This bill prohibits any liquor retailer with a license in this state to require any seal that has been affixed to a bottle or package of intoxicating liquor to be broken or torn before a consumer who purchases the intoxicating liquor is permitted to carry out the intoxicating liquor from the premises of the retailer.

PROPONENTS: Supporters say that this bill protects consumers who obtain bottles with dump dates and the product worsens when opened. People also do not want to gift bottles that have been opened. Forced opening can also be problematic with open container laws.

Testifying for the bill were Representative Schwadron and Arnie C. Dienoff.

OPPONENTS: There was no opposition voiced to the committee.
