HCS HB 382 -- CERTAIN LOCAL TAXES

COMMITTEE ACTION: Voted "Do Pass with HCS" by the Standing Committee on Local Government by a vote of 11 to 0.

The following is a summary of the House Committee Substitute for HB 382.

Currently, certain cities are authorized to impose a transient guest tax of up to 6% and a tax of up to 2% on the gross receipts derived from the retail sales of food by every person operating a food establishment for certain purposes. As originally enacted, the bill applied to the city of Lamar Heights.

This bill would allow such municipality to increase the tax rate on retail sales of food to 6% and would allow both taxes to be used for general revenue purposes. The description of the authorized cities is expanded, and upon enactment the bill will apply to the city of Lamar Heights.

The following is a summary of the public testimony from the committee hearing. The testimony was based on the introduced version of the bill.

PROPONENTS: Supporters say that the income produced by this tax, which the voters must approve, is very much needed.

OPPONENTS: Those who oppose the bill say that once again there is a bill to raise taxes.
