HB 161 -- COUNTY HIGHWAY COMMISSIONS

COMMITTEE ACTION: Voted "Do Pass" by the Standing Committee on Local Government by a vote of 11 to 0. Voted "Do Pass" by the Standing Committee on Rules- Administrative Oversight by a vote of 13 to 0.

Currently, a county that has adopted the Alternative County Highway Commission under Sections 230.200 to 230.260, RSMo, may only abolish it by a vote of the people. This bill adds by a vote of the Governing Body as an additional method.

Currently, once abolished, or in counties that did not adopt the Alternative County Highway Commission, the county shall retain the County Highway Commission under Sections 230.010 to 230.110. This bill allows the county to adopt the County Highway Commission or the county road overseers provided under Sections 231.010 to 231.130.

This bill is the same as HB 1403 (2020).

PROPONENTS: Supporters say that Stone County is the only county they know of with this alternative highway commission and it is a real hassle to recruit people to be on it.

Testifying for the bill were Representative Hudson; and Hank Smythe, County of Stone.

OPPONENTS: Those who oppose the bill say that this decision should be left to the residents.
