HB 36 -- INTERVENTION IN PROSECUTION

This bill authorizes the Attorney General to intervene in any civil or criminal case if the prosecutor in the case is currently under investigation. The bill also authorizes the Governor to order private counsel to act on behalf of the state in any civil or criminal case if the prosecutor in the case is under currently under investigation.

The counsel will have authority to enter into a plea arrangement or request that the court dismiss the case in the interest of justice. Authority is retained until all appeals are exhausted. The bill does not modify the pardon power in any respect.

The bill contains an emergency clause.
