HB 13 -- PROSECUTING AND CIRCUIT ATTORNEYS

This bill specifies that a prosecuting or circuit attorney performing discretionary functions will not be liable for civil damages if his or her conduct does not violate a clearly established statutory or Constitutional right.

Additionally, this bill specifies certain provisions pertaining to the City of St. Louis. It specifies that the Attorney General will have concurrent jurisdiction with any circuity attorney to prosecute under the provisions of this section. It also specifies how the Attorney General may proceed when receiving a referral from a law enforcement agency, as well as how the Attorney General may proceed if the circuit attorney has commenced a prosecution.

The bill also adds the offense of vehicle hijacking, which is a class B felony unless it meets certain criteria specified in the bill, in which case it is a class A felony.

This bill has an emergency clause.
