HB 2378 -- FREEDOM OF TREATMENT ACT

This bill names section 191.480 the "Freedom of Treatment Act".

The bill requires any company or health benefit plan that provides coverage for hospice or palliative care to also provide coverage for investigational drugs that is at least as favorable as the coverage for hospice or palliative care. Coverage of investigational drugs will not be subject to any prior authorization, limits, co-payments, or expenses that do not apply to hospice and palliative care.

The Department of Health and Senior services must publish a website that includes a list of drug developers, physicians, and hospitals that have voluntarily provided the department with a list of diseases and conditions for which they provide invesitgational drugs.

The bill allows an entity to develop and offer new institutional health services to provide investigational drugs to patients.

Any clinical trial for patients with terminal illnesses must provide prospective trial participants with a list of all drug developers, hospitals, and physicians that treat the participant's disease or condition as indicated on the website established by the bill.
