HB 2372 -- PHYSICIAN CERTIFICATIONS

This bill enacts into statute provisions regarding medical marijuana physician certifications issued to a patient under Article XIV of the Missouri Constitution.

This bill requires all physicians to submit a physician certification electronically to the Department of Health and Senior Services, or an alternative format if the electronic system is unavailable.

The physician must submit the physician certification no earlier than 30 days before the patient applies for or renews a medical marijuana patient card.

The physician certification must include the following information:

(1) The physicians name;

(2) The physician's license number;

(3) The physician's type of license;

(4) The physician's business information;

(5) The patient's information;

(6) The patient's qualifying medical condition;

(7) The physician's recommendation for the amount of medical marijuana the patient should be allowed to purchase;

(8) Statements confirming that the physician has received written consent of a parent or legal guardian if the patient is non emancipated and under 18;

(9) A statement that the physician met and examined the patient in person, reviewed the patient's medical records, current medications, and symptoms and has created a medical record for the patient;

(10) A statement that in the opinion of the physician that the patient suffers from a qualifying condition;

(11) A statement that the physician has discussed the risks associated with medical marijuana with the patient; and (12) The signature of the physician.

The department can request to interview any physician who certifies qualifying patients. If a request is made, the physician must arrange for the interview to occur as soon as possible, but at least within 30 days after the department makes the request.

A physician who violates the provisions of the bill are subject to licensure discipline.
