This bill excludes from the provisions of the Merchandising Practices Act any advertisement or transaction of a new residence in which a buyer is offered in the sale contract an express warranty by the builder and the sale contract contains a disclaimer that the sale is excluded from coverage under the Merchandising Practices Act. These provisions only apply to a single-family house, duplex, triplex, quadruplex, or unit in a multi-unit residential structure in which title to each individual unit is transferred to the owner under a condominium or cooperative system.
This bill is the same as HB 790 (2019).
