HB 1697 -- HEALTH INSURANCE REIMBURSEMENT OVERPAYMENT

This bill only allows health carriers to withhold or recoup an overpayment made to a provider or entity from the original provider or entity to whom the payment was overpaid.

The following is a summary of the public testimony from the committee hearing. The testimony was based on the introduced version of the bill.

PROPONENTS: Supporters say that the bill will prevent health carriers from collecting overpayments from providers not involved in a claim. Health carriers will only be able to recoup from the original provider or entity to whom the payment was overpaid.

Testifying for the bill were Representative Henderson; Missouri Dental Association; JC Standlee, Missouri Dental Association; Missouri State Medical Association; and Missouri Association of Rural Health Clinics.

OPPONENTS: Those who oppose the bill say that the bill is not needed. Currently if we have for example 8 dentists under an LLC and we overpay one we can catch back up by paying less to another doctor in the LLC. If there is no relationship with the doctors then this cannot happen, there has to be a relationship.

Testifying against the bill was Blue Cross Blue Shield of Kansas City, Missouri Insurance Coalition, and America's Health Insurance Plans.
