HCS HB 971 -- ABORTION SURVIVORS PROTECTION ACT

COMMITTEE ACTION: Voted "Do Pass with HCS" by the Standing Committee on Children and Families by a vote of 7 to 0. Voted "Do Pass" by the Standing Committee on Rules- Administrative Oversight by a vote of 5 to 3.

This bill establishes the "Born-Alive Abortion Survivors Protection Act" which recognizes a child born alive after or during an abortion as a child with the same rights, privileges and immunities as any other live-born child. Any health care provider shall provide the same care that would be provided to any other child born alive at the same gestational age.

Also, this bill permits a court-appointed administrator to bring a cause of action for loss of life.

This bill is similar to SCS SB 388 (2019).

PROPONENTS: Supporters say that children survive abortions and other states have passed laws allowing babies that survive abortions to be killed, so this bill is necessary to prevent that from happening in Missouri.

Testifying for the bill were Representative Richey; Missouri Right To Life; Concerned Women For America of Missouri; Missouri Catholic Conference; Campaign Life Missouri; and Missouri Family Network.

OPPONENTS: There was no opposition voiced to the committee.
