HB 236 -- ARRESTS MADE BY LAW ENFORCEMENT OFFICERS

Currently, the use of force made in an arrest is justified if, among other things, the amount of physical force used was objectively reasonable in light of the totality of the circumstances. This bill changes that requirement to objectively necessary. Additionally, the bill repeals a section that states that an officer may use all means necessary to effect an arrest if the defendant flees or forcibly resists after the officer gives notice to the defendant of his or her intention to arrest the defendant.
