This bill establishes the "Women's Right to the Pill Act."
The bill requires a pharmacy to fill a valid and lawful prescription for any federal Food and Drug Administration approved drug or device used to prevent pregnancy, including emergency contraceptives, without delay. Pharmacies must stock over-the- counter emergency contraception and make it available to purchase without a prescription.
If the contraceptive is not in stock, the pharmacy must either obtain the contraceptive through a referral or transfer or order the contraceptive through expedited ordering, whichever the customer prefers.
A pharmacy must ensure that its employees do not intimidate, threaten, or harass customers; interfere with the delivery of contraception; intentionally misrepresent or deceive customers about the availability of contraception or its mechanism of action; breach medical confidentiality; or refuse to return a valid, lawful prescription for contraception upon customer request.
Any person harmed from a violation of this section may bring a civil action against the pharmacy for actual and punitive damages, injunctive relief, and reasonable attorney's fees and costs.
