HB 1908 -- SANCTUARY CITIES FOR ILLEGAL ALIENS

This bill adds law enforcement policies to the definition of what may constitute a sanctuary policy by a municipality. The bill also adds to the types of conditions or situations that may indicate that a municipality is a sanctuary city to include: a violation of 8 U.S.C. 1373, regarding communication between governmental agencies and the Immigration and Naturalization Service; a restriction upon the municipality's cooperation with United States Immigration and Customs Enforcement (ICE)to maintain custody of an illegal alien; a requirement that ICE obtain a warrant and demonstrate probable cause before complying with requests of ICE to maintain custody of an illegal alien; and preventing law enforcement officers from asking a person about the person's citizenship or immigration status.

This bill expands the prohibition against sanctuary cities by changing its application from municipalities to political subdivisions.

This bill is similar to HB 980 (2017).
