The bill establishes a new provision in Minnesota Statutes, chapter 383A, that mandates the Metropolitan Council to indemnify Ramsey County and the Ramsey County Regional Railroad Authority for excess liability resulting from rail-related incidents at Union Depot in St. Paul. To qualify for this indemnification, Ramsey County and the Railroad Authority must procure and maintain insurance coverage of at least $50,000,000 for such liabilities. The indemnification will cover any excess liability after applying all applicable insurance proceeds, up to the damages limitation set forth in federal law.

Additionally, the bill clarifies that the insurance obtained by Ramsey County and the Railroad Authority does not waive the liability limits established under existing state laws. The new legal provisions will take effect the day after the bill is enacted.
