A bill to amend 2017 PA 202, entitled
"Protecting local government retirement and benefits act,"
(MCL 38.2801 to 38.2812) by adding section 4a; and to repeal acts
and parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 4a. If a retirement system has a retirement pension
2 benefit, and if a retirement allowance beneficiary designated under
3 the retirement system is a beneficiary of a trust established under
4 42 USC 1396p(d)(4)(A) or (C), the retirement allowance payable to
5 the retirement allowance beneficiary may be paid by the retirement

1 system to the trust on written direction to the retirement system
2 by the retirant or, after the retirant is deceased, by the
3 retirement allowance beneficiary or by the retirant's legal
4 representative if the retirement allowance beneficiary is a minor
5 or is incapacitated.
6 Enacting section 1. Section 2 of the protecting local
7 government retirement and benefits act, 2017 PA 202, MCL 38.2802,
8 is repealed.
