A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 16328a and by adding
sections 17353, 17355, 17357, 17358, 17359, and 17361 to part 173A.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 16328a. Fees for an individual licensed or seeking
2 licensure as a state licensed medical assistant under part 173A are
3 as follows:
4 (a) Application processing fee $10.00

1 (b) License fee, per year $50.00
2 Sec. 17353. (1) Beginning on January 1, 2025, an individual
3 shall not engage in the practice of medical assisting unless
4 licensed or otherwise authorized by this article.
5 (2) Beginning on January 1, 2025, the following words, titles,
6 or letters or a combination thereof, with or without qualifying
7 words or phrases, are restricted in use only to those individuals
8 authorized under this part to use the following terms and in a way
9 prescribed in this part: "medical assistant", "clinical assistant",
10 "state licensed medical assistant", "l.m.a.", or "m.a.".
11 Sec. 17355. (1) The Michigan board of medical assistants is
12 created within the department. The board consists of the following
13 15 members, each of whom must meet the requirements of part 161:
14 (a) Eight state licensed medical assistants.
15 (b) Two of any of the following:
16 (i) A physician.
17 (ii) A chiropractor.
18 (iii) A podiatric physician.
19 (c) Two nurse practitioners.
20 (d) Two physician's assistants.
21 (e) One public member.
22 (2) Except as otherwise provided in this subsection, the terms
23 of office of individual members of the board created under
24 subsection (1), except those appointed to fill vacancies, expire 4
25 years after appointment on December 31 of the year in which the
26 term will expire. For members first appointed under this section, 5
27 members shall serve for 2 years, 5 members shall serve for 3 years,
28 and 5 members shall serve for 4 years.
29 Sec. 17357. (1) Except as otherwise provided in subsection

1 (3), the board shall grant a license under this part to an
2 individual who, in addition to meeting the requirements of section
3 16174, meets all of the following requirements:
4 (a) Subject to subsection (2), the individual has successfully
5 completed 1 of the following:
6 (i) Postsecondary training in medical assisting from an
7 educational program that is accredited by the Accrediting Bureau of
8 Health Education Schools, the Commission for Accreditation of
9 Allied Health Education Programs, or another accrediting
10 organization approved by the board.
11 (ii) An educational program in medical assisting from a school
12 that is institutionally accredited by an accrediting agency that is
13 recognized by the United States Department of Education or by
14 another accrediting organization approved by the board.
15 (b) The individual holds a certification from the American
16 Association of Medical Assistants, the American Medical
17 Technologists, the National Certification Medical Association, or
18 an equivalent certification, as determined by the board.
19 (c) Any other requirements for licensure established by the
20 board.
21 (2) The postsecondary training and education program required
22 under subsection (1)(a) must include courses in anatomy and
23 physiology, medical terminology, pharmacology, medical laboratory
24 techniques, and clinical experience.
25 (3) The board shall grant a license to an individual who meets
26 the requirements of section 16174 and who demonstrates to the
27 satisfaction of the board that the individual has been engaging in
28 the practice of medical assisting for any amount of time during the
29 2-year period immediately preceding January 1, 2025.

1 Sec. 17358. (1) Notwithstanding the requirements of part 161,
2 the board may require a licensee seeking renewal of a license to
3 furnish the board with satisfactory evidence that during the 3
4 years immediately preceding application for renewal the licensee
5 has attended an appropriate number of hours or continuing education
6 courses or programs approved by the board in subjects designed to
7 further educate licensees.
8 (2) An individual is considered to have completed the
9 continuing education requirements described in subsection (1) if
10 the board determines that the individual has met the continuing
11 education standards of the American Association of Medical
12 Assistants or equivalent standards as determined by the board. If,
13 after the effective date of the amendatory act that added this
14 section, the American Association of Medical Assistants revises its
15 continuing education standards, the board may promulgate rules to
16 incorporate the revision by reference.
17 (3) In addition to the continuing education required under
18 subsection (1), the board shall promulgate rules requiring each
19 applicant for license renewal to complete an appropriate number of
20 hours or courses in pain and symptom management as a condition for
21 license renewal as required under section 16204.
22 Sec. 17359. The board shall promulgate rules to implement this
23 part.
24 Sec. 17361. This part does not require new or additional
25 third-party reimbursement or mandated worker's compensation
26 benefits for services rendered by a state licensed medical
27 assistant.
28 Enacting section 1. This amendatory act does not take effect
29 unless Senate Bill No.____ or House Bill No. 5416 (request no.
