A bill to amend 1954 PA 116, entitled
"Michigan election law,"
by amending section 509bb (MCL 168.509bb), as added by 1994 PA 441.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 509bb. (1) A Except as otherwise provided in this act, a
2 clerk shall not cancel or cause the cancellation of the
3 registration of a voter an elector from the registration record of
4 the city or township based solely upon on that registered voter's

1 elector's failure to vote.
2 (2) Every 6 years, beginning with the 2024 general November
3 election, the secretary of state shall, not earlier than 360 days
4 or later than 180 days before the applicable general November
5 election, send by forwardable mail to each registered elector who
6 has not voted for the 6 years before that applicable general
7 November election, both of the following:
8 (a) A postage prepaid and preaddressed return card on which
9 the elector may verify the elector's current address information
10 and on which the elector must sign the elector's name.
11 (b) A notice that contains the following statement:
12 "Secretary of state records indicate that you have not voted
13 in the last 6 years. To confirm your status as a registered
14 elector, please complete, sign, and return the enclosed card
15 providing your current address to the secretary of state within 30
16 days. If you do not complete and return the enclosed card to the
17 secretary of state within 30 days, you will be required to affirm
18 your current address at the polls before you are permitted to vote.
19 To keep your status as a registered elector, you must respond to
20 this notice, vote, or engage in voting-related activity, including,
21 but not limited to, requesting an absent voter ballot application
22 or updating your voter registration, by the first business day
23 after the second general November election that is held after the
24 date on this notice.".
25 (3) If an elector fails to respond to the notice from the
26 secretary of state within 30 days as provided in subsection (2),
27 the secretary of state shall send by forwardable mail to that
28 elector both the postage prepaid and preaddressed return card and
29 the notice as provided under subsection (2)(a) and (b).

1 (4) If an elector fails to respond to the notice from the
2 secretary of state within 30 days as provided under subsection (3),
3 or if a notice sent under subsection (2) or (3) is returned to the
4 secretary of state by the post office as undeliverable, the
5 secretary of state shall identify the registration record of that
6 elector as challenged as provided in this act. If that elector does
7 not vote or engage in voting-related activity by the first business
8 day after the second general November election that is held after
9 the date on the notice provided under subsection (3) or the date on
10 the notice returned to the secretary of state by the post office as
11 undeliverable, the secretary of state shall cancel the voter
12 registration of that elector and notify the appropriate city or
13 township clerk of the cancellation.
