Committee: Criminal Justice
Complete to 2-12-24
SUMMARY:
House Bill 4490 would amend section 21527 of the Public Health Code, which requires a
doctor or other attending or admitting hospital staff member who is told by an individual that
the individual was the victim of criminal sexual conduct within the previous five days to inform
the individual about the availability of a sexual assault medical forensic examination, including
the administration of a sexual assault evidence kit. The doctor or staff member must perform
the forensic examination, if the individual consents, and must let the individual know that 1976
PA 223, the crime victims compensation act, provides for payment of the examination’s costs. 1
The bill would add that, if the hospital has a shower facility, an individual administered a sexual
assault evidence kit as described above has a right to access the shower facility at no cost after
the administration of the sexual assault evidence kit.
MCL 333.21527
FISCAL IMPACT:
The bill would have no fiscal impact on the state or on local units of government.
