A bill to make, supplement, and adjust appropriations for
various state departments and agencies for the fiscal year ending
September 30, 2023; to provide for certain conditions on
appropriations; to provide for the expenditure of the
appropriations; and to repeal acts and parts of acts.

10 PROVISIONS CONCERNING APPROPRIATIONS
11 GENERAL SECTIONS
12 Sec. 201. Pursuant to section 30 of article IX of the state
13 constitution of 1963, total state spending from state sources under
14 part 1 for the fiscal year ending September 30, 2023 is $0.00 and
15 total state spending from state sources to be paid to local units
16 of government is $0.00.
17 Sec. 202. The appropriations made and expenditures authorized
18 under this part and part 1 and the departments, commissions,
19 boards, offices, and programs for which appropriations are made
20 under this part and part 1 are subject to the management and budget
21 act, 1984 PA 431, MCL 18.1101 to 18.1594.
22 Sec. 203. If the state administrative board, acting under
23 section 3 of 1921 PA 2, MCL 17.3, transfers funds from an amount
24 appropriated under this act, the legislature may, by a concurrent
25 resolution adopted by a majority of the members elected to and
26 serving in each house, intertransfer funds within this act for the
27 particular department, board, commission, office, or institution.

1 Sec. 301. (1) Funds appropriated in part 1 for state veterans
2 cemetery must be expended by the department for only 1 or more of
3 the following purposes:
4 (a) Acquiring and purchasing land in a county with a
5 population of not less than 12,980 and not greater than 12,985
6 according to the most recent federal decennial census that is
7 suitable for a state veterans cemetery.
8 (b) Designating land owned by this state under the
9 jurisdiction of the department in a county with a population of not
10 less than 12,980 and not greater than 12,985 according to the most
11 recent federal decennial census as a state veterans cemetery.
12 (c) Applying for and accepting all grants available under 38
13 USC 2408.
14 (d) Cemetery design or engineering plans, or both, and any
15 necessary environmental impact studies prescribed by law.
16 (e) Necessary expenses to qualify for federal grants under 38
17 USC 2408.
18 (f) Preparing the land that is acquired or purchased for a
19 state veterans cemetery or designated as a state veterans cemetery
20 for operational use.
21 (g) Ongoing expenses related to the operation of a state
22 veterans cemetery.
23 (2) The unexpended funds appropriated in part 1 for state
24 veterans cemetery are designated as a work project appropriation.
25 Any unencumbered or unallotted funds shall not lapse at the end of
26 the fiscal year and shall be available for expenditures for the
27 project under this section until the project has been completed.
28 The following is in compliance with section 451a of the management
29 and budget act, 1984 PA 431, MCL 18.1451a:

1 (a) The purpose of the project is to create a state veterans
2 cemetery in a county with a population of not less than 12,980 and
3 not greater than 12,985 according to the most recent federal
4 decennial census.
5 (b) The project will be accomplished by state employees,
6 contracts with vendors, or both.
7 (c) The total estimated cost of the project is $12,000,000.00.
8 (d) The tentative completion date is September 30, 2027.

10 REPEALER
11 Sec. 401. Section 601 of article 10 of 2022 PA 166 is
12 repealed.
