HOUSE BILL NO. 6549

A bill to amend 1976 PA 451, entitled

"The revised school code,"

(MCL 380.1 to 380.1852) by adding section 1451a.

the people of the state of michigan enact:

Sec. 1451a. (1) Subject to subsection (2), the board of a school district or intermediate school district or board of directors of a public school academy shall develop or adopt and implement a policy concerning each library operated by the board or board of directors that, at a minimum, includes all of the following:

(a) A breakdown of both of the following, including any processes involved with the following:

(i) The rights and responsibilities of the parents and legal guardians of pupils enrolled in the school district, intermediate school district, or public school academy with regard to the review of materials in a library described in this subsection.

(ii) The rights of individuals of the public to review materials in a library described in this subsection.

(b) A procedure that allows for the parents or legal guardians of pupils enrolled in the school district, intermediate school district, or public school academy to access a list of books or materials borrowed from a library described in this subsection by the parent's or legal guardian's child.

(c) A requirement that, beginning January 1, 2023, the board or board of directors shall ensure that a list of all new books purchased for or donated to each library described in this subsection is made available to the public on the school district's, intermediate school district's, or public school academy's website for a public review period that must last, at a minimum, 60 days, beginning on the date of the purchase or donation. This subdivision does not apply as follows:

(i) With regard to books purchased as or donated as a replacement for damaged or lost books that already appeared on a list described in this subdivision.

(ii) If a school does not have a full-time library media specialist working at the school or individual working at the school in an equivalent position.

(d) A requirement that, beginning January 1, 2023, the board or board of directors shall make available a catalog of new books purchased for or donated to each library described in this subsection in each school operated by the board or board of directors in a manner that is accessible to the public for a public review period that must last, at a minimum, 60 days, beginning on the date of the purchase or donation. This subdivision does not apply as follows:

(i) With regard to books purchased or donated as a replacement for damaged or lost books that already appeared in a catalog described in this subdivision.

(ii) If a school does not have a full-time library media specialist working at the school or individual working at the school in an equivalent position.

(iii) If a school is a cyber school as that term is defined in section 551.

(e) A requirement that the board or board of directors shall ensure that the parents and legal guardians of pupils enrolled in the school district, intermediate school district, or public school academy receive notice, at least 7 days before the first day the list or catalog will be made available or posted, of the date a list or catalog described in subdivision (c) or (d) will be made available or posted and the date that list or catalog will be removed from the website or school building.

(2) For purposes of this section, a library assembled by school staff or school personnel within a classroom is considered a library operated by the board of the school district or intermediate school district or board of directors of the public school academy that operates the school in which that library is located.
