SUMMARY:
House Bill 5939 would amend section 6 of the State School Aid Act to allow a district to count
a pupil in membership without the approval of the pupil’s district of residence if the pupil’s
parent or legal guardian is a member of the Armed Forces of the United States and has
provided the enrolling district with a dated document from the parent’s or guardian’s
commanding officer that confirms both of the following:
• The pupil is in temporary military housing.
• The pupil will become a resident of the enrolling district no later than 12 months after
the date of the document.
Armed Forces of the United States would mean the United States Army, Air Force,
Navy, Marine Corps, Space Force, or Coast Guard or other military force designated
by Congress as part of the Armed Forces of the United States, including the reserve
components.
Section 6 of the School Aid Act generally requires a district to have the approval of the pupil’s
district of residence to count the pupil in membership, except that approval is not required in
certain specified cases. The bill would add the exception described above.

FISCAL IMPACT:
The bill would have minimal fiscal impact on the state and on local school districts,
intermediate school districts (ISDs), and public school academies (PSAs).
There may be some negligible cost increases or decreases for the state depending on whether
a student is transferring to a district with a higher or lower foundation allowance and depending
on the proportion of the state/local mix of a district’s foundation allowance.
A local school district, ISD, or PSA would see nominal changes in per-pupil funding depending
on whether they were losing or gaining a pupil.
