10 COMMITTEE AMENDMENT “ ” to H.P. 1223, L.D. 1652, “An Act To Build a
11 Child Care System by Recruiting and Retaining Maine's Early Childhood Educators
12 Workforce”
13 Amend the bill by striking out everything after the enacting clause and inserting the
14 following:
15 'Sec. 1. 20-A MRSA §15688-A, sub-§10 is enacted to read:
16 10. Career and technical education; early childhood education program
17 expansion support. Beginning in fiscal year 2022-23, the commissioner may expend and
18 disburse funds to career and technical education centers and career and technical education
19 regions for the purpose of expanding or developing early childhood education programs.
20 Sec. 2. 22 MRSA §3737-A is enacted to read:
21 §3737-A. Early childhood educator workforce salary supplements
22 The department shall develop and implement a system to provide salary supplements
23 to child care providers and early childhood educators who provide direct services to
24 children in a child care facility licensed under section 8301-A, subsection 2 or who are
25 family child care providers licensed under section 8301-A, subsection 3. Any salary
26 supplement funding provided by the department under this section to a child care facility
27 or family child care provider must be paid by that child care facility or family child care
28 provider in order to increase wages for any child care provider or early childhood educator
29 who provides direct services to children.
30 Until June 30, 2023, a child care facility or family child care provider shall distribute
31 salary supplements received under this section in the same amount to any child care
32 provider or early childhood educator who provides direct services to children employed by
33 the facility or provider. Beginning July 1, 2023, the department shall establish by rule and
34 shall implement a tiered system for salary supplements under this section. The rules must
35 provide, at a minimum, 3 tiers based on the education and experience levels of child care

1 providers and early childhood educators. The 2nd tier must provide a salary supplement

2 that is at least 50% greater than the first tier and the 3rd tier must provide a salary
38
3 supplement that is at least 50% greater than the 2nd tier. Rules adopted under this section
39
4 are routine technical rules pursuant to Title 5, chapter 375, subchapter 2-A.
5 Sec. 3. Appropriations and allocations. The following appropriations and
6 allocations are made.

7 Amend the bill by relettering or renumbering any nonconsecutive Part letter or section
8 number to read consecutively.
9 SUMMARY
10 This amendment replaces the bill. The amendment provides $100,000 for the
11 Commissioner of Education to expend and disburse to career and technical education
12 centers and career and technical education regions for the purpose of expanding or
13 developing early childhood education programs. The amendment also directs the
14 Department of Health and Human Services to implement a system of salary supplements
15 for child care providers and early childhood educators. The amendment provides for
16 funding for 2 positions within the child care services division of the department and funding
17 for the salary supplements, which represents 9 months of salary supplements.
