 1 Sec. 1. Department of Health and Human Services to increase
2 reimbursement rates for home-based services. Resolved: That, by January 15,
3 2022, the Department of Health and Human Services shall increase the hourly
4 reimbursement rates for home-based services:
5 A. By 39% for registered nurse and licensed practical nurse services provided under
6 the waiver services provisions of rule Chapter 101: MaineCare Benefits Manual,
7 Chapters II and III, Section 19;
8 B. By 39% for registered nurse, licensed practical nurse and independent registered
9 nurse services provided under the provisions of rule Chapter 101: MaineCare Benefits
10 Manual, Chapters II and III, Section 96; and
11 C. By 39% for registered nurse, licensed practical nurse and independent registered
12 nurse services provided under the provisions of rule Chapter 5: Office of Aging and
13 Disability Services Policy Manual, Section 63.
14 Sec. 2. Department of Health and Human Services to index reimbursement
15 rates for certain home-based services. Resolved: That, by January 15, 2022, the
16 Department of Health and Human Services shall index the reimbursement rates for home-
17 based services provided under rule Chapter 101: MaineCare Benefits Manual, Chapters II
18 and III, Section 40 to the low-utilization payment adjustment rate in accordance with 42
19 Code of Federal Regulations, Section 484.230.
20 SUMMARY
21 This resolve directs the Department of Health and Human Services to increase
22 reimbursement rates for nursing services for certain home-based services by January 15,
23 2022 and to index the reimbursement rates for certain home-based services provided under
24 rule Chapter 101: MaineCare Benefits Manual, Chapters II and III, Section 40 to the low-
25 utilization payment adjustment rate by January 15, 2022.
