1 Be it enacted by the People of the State of Maine as follows:
2 Sec. 1. 22 MRSA §1711-C, sub-§12, as enacted by PL 1997, c. 793, Pt. A, §8 and
3 affected by §10, is amended to read:
4 12. Minors. If a minor has consented to health care in accordance with the laws of
5 this State, authorization to disclose health care information pursuant to this section must be
6 given by the minor unless otherwise provided by law. Notwithstanding subsection 2, if a
7 health care facility or health care practitioner maintains the records of the minor's health
8 care information electronically, any authorization to disclose health care information by a
9 minor authorized pursuant to this section must include electronic access to the minor's
10 health care records.
11 SUMMARY
12 This bill amends the laws governing the confidentiality of health care information to
13 provide that if a health care facility or health care practitioner maintains a minor's records
14 electronically, then the records must be provided electronically to any person who is
15 authorized to access the minor's health care records.
