9 COMMITTEE AMENDMENT “ ” to H.P. 1039, L.D. 1423, “An Act To Prevent
10 and Reduce Tobacco Use by Ensuring Adequate Funding for Tobacco Use Prevention and
11 Cessation Programs and by Raising the Tax on Tobacco Products and To Provide Funding
12 To Reduce Disparities in Health Outcomes Based on Certain Factors”
13 Amend the bill by striking out the title and substituting the following:
14 'An Act To Align Tobacco Use Prevention and Cessation Funding with
15 Recommendations of the United States Centers for Disease Control and Prevention'
16 Amend the bill by striking out everything after the enacting clause and inserting the
17 following:
18 'Sec. 1. 22 MRSA §273 is enacted to read:
19 §273. Funding requirements
20 The amount annually appropriated or allocated and used for the program may not be
21 less than the lesser of:
22 1. Cigarettes and tobacco products revenue and Fund for a Healthy Maine funds.
23 The amount of tax revenue projected to be collected during the fiscal year on cigarettes and
24 tobacco products under Title 36, chapters 703 and 704, respectively, plus funds available
25 in the Fund for a Healthy Maine pursuant to section 1511, subsection 2, paragraphs A and
26 C as identified by the Treasurer of State in reports submitted pursuant to section 1511,
27 subsection 8; and
28 2. Recommended funding level. The funding level recommended for this State by
29 the United States Department of Health and Human Services, Centers for Disease Control
30 and Prevention pursuant to its determination for state tobacco control programs.
31 For purposes of this section, "cigarettes" has the same meaning as in Title 36, section
32 4361, subsection 1-A and "tobacco products" has the same meaning as in Title 36, section
33 4401, subsection 9.

11 Amend the bill by relettering or renumbering any nonconsecutive Part letter or section
12 number to read consecutively.
13 SUMMARY
14 This amendment replaces the bill. It changes the title of the bill and removes the
15 proposed increase in the tax on cigarettes and other tobacco products. It retains provisions
16 of the bill requiring funding of the Tobacco Prevention and Control Program administered
17 by the Department of Health and Human Services, Bureau of Health to be a minimum of
18 the actual revenue collected on the sales of all tobacco products plus available funds in the
19 Fund for a Healthy Maine or the amount of funding for state tobacco control programs as
20 determined by the United States Department of Health and Human Services, Centers for
21 Disease Control and Prevention and recommended for the State, whichever is less.
22 The amendment also adds an appropriations and allocations section.
